  1. These Terms of Use occasionally refer to our Privacy Policy, this policy sets out the terms on which we process any personal data we collect from you, or that you provide to us and can be found at www.web2jobs.eu/privacypolicy. By using the Site, you consent to such processing and you warrant that all data provided by you is accurate.
  2. If you use the Site to subscribe to any of our services, our then current Terms and Conditions of Supply will apply to that subscription.

ACCESSING THE SITE

  1. You will be able to access most areas of this Site without registering your details with us. Certain areas of this Site are only open to you if you register.
  2. We may, from time to time, restrict access to additional parts of the Site, or the entire Site, to users who have registered with us.
  3. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms of Use.

TRANSACTIONS CONCLUDED THROUGH THE SITE

  1. Unless expressly stated otherwise, nothing in the Site is intended as a contractual offer for the provision of our goods or services capable of acceptance by you as principal or agent.

CANCELLING YOUR REGISTRATION AS A USER

  1. You can cancel your registration as a user of the Site at any time but this will not affect any agreements you have entered into with us or your obligations in relation to any services or information which you have already received.

INTELLECTUAL PROPERTY RIGHTS

  1. We are the owner or licensee of all intellectual property rights in the Site and the material published on it. These works are however copyfree to all those who register and are accepted onto our site. All such rights are reserved.
  2. You may print off one copy, and may download any of the training materials presented on the site for your personal reference and for use within your training programmes. You may draw the attention of others within your organisation to material posted on the Site. Such use is subject to the following restrictions:

17.1         no copyright documents or related graphics on this Site may be modified in any way;

17.2         no graphics on this Site may be used separately from accompanying text;

17.3         our copyright and trade mark notices and this permission notice must appear in all copies; and

17.4         our status and that of the web2jobs consortium as the authors of content on the Site must always be acknowledged.

17.5         Funding support from the European Commission must always be acknowledged along with the following statement:  “This module/publication was funded with support from the European Commission. This publication reflects the views only of the author and the Commission cannot be held responsible for any use which may be made of the information contained therein.”

  1. You must not use any part of the materials on the Site for commercial purposes or for any other purpose not permitted by these Terms of Use without obtaining a license to do so from us or our licensors.

CONTENT OF THE SITE

  1. Unless expressly agreed otherwise commentary and other materials posted on the Site is indicative only and is not intended to amount to advice on which reliance should be placed. Such commentary and materials should. We will have no liability or responsibility for any reliance placed on such materials by any visitor to the Site or by anyone informed of any of its contents.
  2. You should not act or refrain from acting based on any information you obtain from the Site unless you have taken appropriate specific advice from a suitably qualified individual.
  3. We reserve the right to withdraw or amend the Site or any service we provide on the Site without notice. We may also change the content of the Site at any time. If the need arises, we may suspend access to the Site, or close it indefinitely.
  4. Any of the material on the Site may be out of date at any given time; we are under no obligation to update such material.

LIABILITY AND STATUS

  1. The material and content displayed on the Site is provided without any guarantees, conditions or warranties from us as to its accuracy or completeness. To the extent permitted by law, we and the partners in the company expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
  2. If you are a business user, we will not be responsible to you for:

24.1         any losses which are not a foreseeable consequence of an act or omission by us relating to the Site. Losses are foreseeable where they  could be contemplated by you and us at the relevant time you used the Site;

24.2         loss of income, revenue, business, profits, contracts or sales (whether direct or indirect);

24.3         loss of anticipated savings;

24.4         loss of or corruption to data;

24.5         loss of goodwill; or

24.6         wasted management or office time.

  1. If you are a consumer user, please note that we only provide the Site for domestic and private use. You agree not to use the Site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
  2. We will have no liability or responsibility if for any reason the Site is unavailable at any time or for any period.
  3. Access to this Site may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.
  4. We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Site or to your downloading of any content on it, or on any site linked to it. You are responsible for configuring your information technology, computer programmes and platform in order to access the Site. You should use your own virus protection software.
  5. Regardless of the previous paragraphs in this section, if we are found to have any liability to you, that liability will be limited to 10€ for each event.
  6. Nothing in these Terms of Use is intended to exclude or limit Apricot Training Managements’ liability for:

30.1         death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors;

30.2         fraud or fraudulent misrepresentation; or

30.3         any other liability which cannot be excluded or limited under applicable law.

  1. You agree to indemnify (i.e. reimburse) us, our Consortium partners, our officers, directors, employees, agents and group companies, against all claims, liability, damages, losses, costs (including reasonable legal fees) arising out of any breach of these Terms of Use by you, or your use of the Site, or the use by any other person using your registration details.

INFORMATION ABOUT YOU AND YOUR VISITS TO THE SITE

  1. We process any personal information you may provide to us in accordance with our privacy policy which may be accessed at www.web2jobs/privacypolicy. By using the Site, you consent to that processing and you warrant that all data provided by you is accurate.
  2. Any non-personal material or information which you transmit or post to the Site will be considered non-confidential and non-proprietary. We will have no obligations with respect to such material. We and our nominees will be free to copy, disclose, distribute, incorporate and otherwise use such material and all data, images, sounds, text and other things embodied therein for any and all commercial or non-commercial purposes.

VIRUSES, HACKING AND OTHER OFFENCES

  1. You must not:

34.1         post or transmit to the Site any material that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience;

34.2         post or transmit to the Site any material for which you have not obtained all necessary licenses and/or approvals;

34.3         post or transmit to the Site any material which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in the UK or any other country in the world;

34.4         post or transmit to the Site any material which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data);

34.5         attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site;  or

34.6         attack the Site via a denial-of-service attack or a distributed denial-of-service attack.

By breaching this Paragraph 34, you may be committing a criminal offence. We may report any such breach to the relevant law enforcement authorities and disclose your identity and relevant personal details to them. In the event of such a breach, your right to use the Site will cease immediately.

LINKS TO AND FROM THE SITE

  1. You may link to our home page provided that you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, and does not suggest any form of association, approval or endorsement on our part where none exists. Such use shall, in particular, be subject to the following conditions:

35.1         you do not remove, distort or otherwise alter the size or appearance of the Self Awareness® logo;

35.2         you do not create a frame or any other browser or border environment around this Site;

35.3         you do not in any way imply that we are endorsing any products or services other than our own;

35.4         you do not misrepresent your relationship with us nor present any other false information about us;

35.5         you do not otherwise use any Self Awareness Registered Trade Marks displayed on this Site without our express written permission;

35.6         you do not link from a website that is not owned by you; and

35.7         your website does not contain content that is distasteful, offensive or controversial, infringes any intellectual property rights or other rights of any other person or otherwise does not comply with all applicable laws and regulations.

  1. Subject to Paragraph 17, no part of the Site may be framed, reproduced or stored in any other website or included in any public or private electronic retrieval system or service without our prior written permission.
  2. We reserve the right to withdraw linking permission without notice.
  3. Where the Site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources and accept no liability or responsibility for them or for any loss or damage arising from your use of them. Please, in particular, note that such third party sites may use any personal data which you provide to them in ways which we would not, you should review such third party’s privacy policies before providing any such information to them.

  1. No partnership or agency: No agency, partnership, joint venture, employment relationship or franchise relationship is intended or created between you and us as a result of your use of the Site or by you entering into any contract to buy goods or services via the Site.
  2. Variations: We may revise these Terms of Use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these Terms of Use may also be superseded by provisions or notices published elsewhere on the Site. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use the Site.

Assignment: We may at any time assign, transfer, mortgage, charge, subcontract or deal in any other manner with all or any of its rights under the these Terms of Use and may subcontract or delegate in any manner any or all of its obligations under these Terms of Use to any third party or agent. You shall not, without our prior written consent, assign, transfer, mortgage, charge, subcontract, declare a trust over or deal in any other manner with any or all of its rights or obligations under these Terms of Use.

Severance: If any provision or part-provision of these Terms of Use is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this Paragraph 44 shall not affect the validity and enforceability of the rest of these Terms of Use.
  5. Third parties: A person who is not a party to these Terms of Use shall not have any rights to enforce their terms.

JURISDICTION AND APPLICABLE LAW

  1. Each party irrevocably agrees that the courts of England and Wales shall have non-exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms of Use (including non-contractual disputes or claims).
  2. These Terms of Use, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), shall be governed by, and construed in accordance with the law of England and Wales.
  3. We do not warrant that materials/items on the Site are appropriate or available for use outside the United Kingdom. It is prohibited to access the Site from territories where its contents are illegal or unlawful. If you access this Site from locations outside the United Kingdom, you do so at your own risk and you are responsible for compliance with local laws.
